1. Purpose

Cre'Online, through its site www.opinagora.com ("Opinagora"), invites people who voluntarily register to take part in online surveys and missions. Once registered, members who become panelists can earn points, in particular:

Points can be redeemed for rewards under the conditions described in these terms and on the "Withdrawal" page of the site. These Terms of Service set out the conditions under which the Members of Opinagora, meaning holders of an Account on www.opinagora.com, may use these services.

Cre'Online reserves the right to accept or refuse the registration of any person to its panel without having to provide justification.

4. Login and password

The Member holding an Account is identified by an email address and a password. The password, which allows the Member to sign in and access the services, is personal and confidential. The Member is solely responsible for the use of their password. Using another member's login and password is strictly prohibited.

5. Panelist's duties

In general, the panelist is encouraged to take part actively and regularly in the surveys and missions offered to them. Participation is not mandatory. The Member undertakes to answer honestly and spontaneously the questions asked, according to their personality, tastes and concerns. They undertake to keep confidential the nature of the products, concepts and content presented in surveys and product tests.

The Member undertakes to update their personal information regularly. The contract is personal and unique: each Member may hold only one Account and may not assign all or part of their rights and obligations to a third party.

The Member may refer other members, but such referrals must be carried out genuinely. Cre'Online reserves the right to permanently deactivate the Account of any Member making fraudulent referrals (non-existent persons, etc.) or failing to comply with these terms.

6. Non-compliance and liability

In the event of a breach of your commitments, fraud, the creation of multiple accounts, or non-compliance with these terms, Cre'Online reserves the right to suspend or delete your Account immediately and without formality. In such cases, points wrongly acquired may be cancelled.

7. Term of the contract

This contract takes effect when the Member accepts these terms, subject to confirming the creation of their Account by validating the link received by email, and remains in force until the Account is terminated. The Member may terminate at any time by deleting their Account from their profile page ("Delete my account" option).

8. Panelist rewards

In return for their participation, the Member receives points. The reward in points associated with a survey or a mission is communicated to them before participation. The Member may also be granted points when one of their referrals completes a rewarded action on the panel.

Points are converted into rewards at a rate of 100 points for 1 USD. A minimum withdrawal threshold applies and may vary depending on the Member's country. Rewards may take the form of gift cards, PayPal, prepaid cards or physically shipped products (Product Tests). The exact terms (threshold, options and timelines) are detailed on the "Withdrawal" page of the site.

When the Member unsubscribes, the remaining points balance is permanently lost.

9. Creation of a Members file

Cre'Online creates a file containing information about its Members. The purpose of collecting this information is to build and operate a panel of panelists likely to take part in market research matching their profile. Cre'Online implements appropriate technical and organisational measures to protect personal data. 10. Limitation of liability

The rewards and products sent are intended for the Member, who is solely responsible for the use they make of them. Cre'Online is in no way responsible for the use made of the rewards or products sent to its Members. It is the responsibility of each Member to comply with the conditions of use prescribed by the company producing or distributing the service or product made available to them. The use of a product provided is the sole and entire responsibility of the Member. Cre'Online cannot be held liable for the misuse of a product sent.

11. Accessing and managing your personal data

In accordance with the General Data Protection Regulation, each Member has rights over their personal data: right of access, rectification, erasure, restriction of processing, objection, withdrawal of consent and portability. Each Member may exercise at any time the rights of access, modification and deletion through their Account, and contact us at [email protected] for the other rights. 12. Intellectual property and infringement

Cre'Online owns the intellectual property rights or holds the usage rights to all elements accessible on the site, including text, images, graphics, logos, icons, sounds and software. Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the site, by whatever means or process, is prohibited without prior written authorisation. Any unauthorised exploitation of the site or of any of its elements will be considered an infringement and prosecuted in accordance with Articles L.335-2 et seq. of the French Intellectual Property Code.

13. Cookies

When browsing the site, one or more cookies may be placed on the Member's device, in particular to facilitate the operation of the service, ensure security and produce statistics. The Member may manage their cookie preferences. For more information, please refer to our Cookie Policy.

14. Availability of services

Cre'Online strives to keep Opinagora accessible 7 days a week and 24 hours a day, without being bound by an obligation of result. Cre'Online may interrupt access, in particular for maintenance, upgrades or any other technical reason. Cre'Online is not responsible for these interruptions or their consequences for the Member or any third party. Cre'Online may discontinue its services or modify their characteristics at any time, without notice.

15. Internet network

The Member declares that they are aware of the characteristics and constraints of the Internet, in particular that the transmission of data benefits only from relative technical reliability, as it travels over heterogeneous networks whose characteristics and capacities may disrupt access or make it impossible at certain times.

16. Citation, promotion and advertising

Cre'Online may quote the information that the Member has explicitly declared usable, for the purposes of the presentation, promotion, advertising or marketing of its activities or services.

17. Changes, governing law and disputes

Cre'Online may modify its services or these Terms of Service, in particular to reflect the technical or regulatory evolution of the service. Cre'Online informs Members of changes to the Terms of Service, which are published on the site; it is the Member's responsibility to review them. If you do not accept the changes, you may stop using the service and delete your Account.

These Terms of Service are governed by French law, without prejudice to the mandatory protective provisions applicable in the consumer Member's country of residence. In the event of a dispute, the parties will seek an amicable solution before any legal action; failing that, the dispute will be brought before the competent courts.
